These terms and conditions apply to all client's (the "Client", "Member", "Guest" and/or "Client"), Member's, Clients and their guests. We may refer to our customers/clients as 'Members' in this document. Anyone using any service, product or membership provided by The Lexo Club or its affiliated companies are subject to these terms and conditions at all times. They are subject to change at any point and it is your responsibility to check this regularly for any changes. Any person using, purchasing or obtaining a Ticket, Product, Service and/or Membership from The Lexo Club are subject to these Terms and Conditions:
The Lexo Club maybe referred to (but not limited to) as "The Lexo Club", "Lexo Club", "Lexo", "we", "us" or "our".
"Contract" means the treaty for the provision of services which shall be governed by these Terms and Conditions.
"Payment Card" or "Payment Method" means credit/debit or charge card of which we hold the details.
"Membership", "Gold Card", "Platinum Card", "Black Card" or "Cardholder" is referring to membership within The Lexo Club. We may also refer to applicants (people in the process of submitting an application or have submitted an application) as members as all terms apply to applicants as well.
When referring to "Members", we are also referring to customers/clients as some of our customers/clients may not have an active subscription but all terms and conditions that apply to members, still apply to all customers/clients. When a customer/client of ours is using our services or products, then all of the terms and conditions applicable to our members, also apply to them. By purchasing or accepting a service or product of ours (or our partners via The Lexo Club), you also agree to any Terms & Conditions applicable in this contract to both members & non-members.
The following terms and conditions (the "Terms") govern the use of our website(s) (the "site"), Lexo Club membership, any services we offer (regardless of whether or not you're a member), guests of members or The Lexo Club.

When a customer/client of ours is using our services or products, then all of the terms and conditions applicable to our members, also apply to them. By purchasing or accepting a service or product of ours (or our partners via The Lexo Club), you also agree to any Terms & Conditions applicable in this contract to both members & non-members.
The following terms and conditions (the "Terms") govern the use of our website(s) (the "site"), Lexo Club membership, any services we offer (regardless of whether or not you're a member), guests of members or The Lexo Club.
Our Contract
Please read these Terms carefully before using the site or any services provided by The Lexo Club and its affiliates. For the purposes of these Terms:
- All members must be at least 18 years of age and posses the legal authority to enter into this agreement.
- Members are subject to background checks at our discretion throughout the application process, while being a member and also their guests. This is to protect the interest of the exclusive events and comply with security protocols.
- Members will have to complete an application form provided by The Lexo Club (only) that will ask an array of personal questions to gather whether or not we are suitable for each other in the sense of providing an excellent service and ensuring all members are overly happy with their membership. It is at our discretion whether or not an applicant is accepted to become a member. We reserve the right to accept or refuse any member. We also reserve the right to make renewing members apply again.
- Members or clients of The Lexo Club may not authorise or allow anyone else to use their membership or any of its features and benefits in any form unless agreed upon by both the member and The Lexo Club in writing.
- Information provided to us in any form by members, their guests or clients/customers must be true and accurate. We also reserve the right to complete background checks on the information provided to us to confirm whether or not its true and accurate.
- When using your membership in any form or using The Lexo Club website you agree to be bound by these Terms, which shall form a legally binding agreement between you and us.
- We reserve the right to update or change these terms at any time at our own discretion and your continued use of our service/membership will be subject to the then current version of these terms. We recommend that you read the current version of these terms each time before you use the any services or features of your membership.
Membership
- Membership is subject to the fees at the time of being accepted by The Lexo Club. Membership is currently subject to a minimum period of twelve months. It may be extended at the discretion of The Lexo Club. It is entirely at the discretion of The Lexo Clubs Management Department to raise, lower or waive any membership fees.
- Membership must be paid for in full upfront before becoming a member or on an agreed upon monthly payment plan.
- No individual under 18 years of age shall be eligible to become a member, nor will they be accepted to any form of membership with The Lexo Club.
- Details provided to us when applying for membership must be both accurate and true, this is an ongoing obligation, and we must be notified of any details as soon as reasonably possible. Incorrect or fraudulent information provided by you to us may invalidate your membership and/or lead to legal proceedings.
- Any membership card provided by us is property of The Lexo Club at all times and must be returned to us, should we request you to do so.
- Membership & membership cards are non transferable and can only be used by the member. Membership cards must be signed by the member on the reverse (in the appropriate space) to be valid. Any venue or person checking the membership may ask you to match the signature.
- As a member of The Lexo Club you have a duty to notify us immediately by email if your membership card is lost or stolen. You are responsible for your membership card.; lost or stolen membership cards may be replaced at a fee of £90. This fee may be waived at our discretion.
- Upon termination or expiration of your membership card you must return to The Lexo Club or destroyed in accordance to our instruction.
- Benefits and services are only available to members who have no outstanding fees with us or our partners.
- Services provided by us to our members are confidential. Provision of these services are on the agreement that members requests and the solutions offered are not publicised to non-members.
- Any information provided to you as a member such as (but not limited to) event schedules, itineraries, events, guest information or any thing else provided to you as a member is strictly confidential. We are provided confidential information by partners to be kept private between our members and the events guests. You are in a privileged position to have access to this information and miss-use of it will result in a termination of your account at our discretion. The definition of miss-use is at our discretion. Sharing any information would be a clear example of miss-use.
- All details you provide to us relating to purchasing or booking goods and/or services are both accurate and true and the payment card you are using is your own and has sufficient funds to cover the cost of the goods and/or services.
- You agree not to impersonate any other person or entity or to use a false name.
- You are entitle to an initial 14 day grace period from the moment of your application being accepted, in which you can change your mind and terminate your application and invoice to pay. You can also recieve a refund minus a 15% administration fee to cover any incurred costs if you have paid your invoice and are still within your grace period.
- Membership may automatically be renewed one month before your expiration. You will be informed and can disable auto renewal at any time prior to renewal payment date. Your renewed membership will not start till your current membership expires.
- Current membership fees can always be found by visiting our website ("thelexo.club"), selecting the membership you wish and pressing the "Fees" button below. You will then find the fees associated to membership.
- If your account falls into arrears or has any outstanding payments due to us or partners then we may suspend your membership/account until paid. We reserve the right to add an interest rate of 8% plus the Bank of Englands base rate. We also reserve the right to claim any and all reasonable debt recovery costs past this point.
- We reserve the right to suspend, terminate, not allow renewal or require you to re-apply upon membership expiration if you have breached any of our terms.
- If any payment made to us fails then we will either try and collect payment again shortly after or contact you to make a payment. We reserve the right not to renew your membership or make you reapply for membership upon renewal if we struggle to take payments from you regularly.
- We reserve the right to add money on to the cost of goods and/or services we purchase on a member(s) or their guests behalf at our own discretion within reason to cover administration costs.
- Where a service required a deposit to be paid you herby authorise us to debit your payment card for the required amount. This may be forfeited, subject to the terms and conditions of the service/event/goods, as a result of cancellation.
- When ordering a product or service or accessing a benefit, you may be required to provide your payment card details. If you request and authorise The Lexo Club to use your payment card in order to pay a supplier/partner/external company for products or services, you acknowledge and agree that we shall have no liability in respect of or be responsible in any way whatsoever in respect of the use of your payment card provided that we act in accordance with these instructions issued by you. Occasionally, certain goods and/or service may incur a pre-agreed handling or transportation fee, you hereby authorise The Lexo Club to debit your payment card to cover these. You will be notified of these fees prior.
- In the event that you request The Lexo Club to make a purchase on your behalf you hereby authorise us to deduct the amount plus any applicable fees and charges. If payment of any sum due under this agreement is not received by any due date specified for that sum, The Lexo Club shall be entitled to charge interest on the outstanding amount at the rate of 8% above the base lending rate of the Bank of England, accruing daily.
- Should you terminate your membership with The Lexo Club, any outstanding payments owed to us will be taken from your registered credit card upon termination of your membership.
- There are no refunds available for membership fees for periods outside of the initial 14 day grace period. We reserve the right not to issue refunds for any goods and/or services provided by us, our suppliers or any partner due to the nature of this business.
- If your account has been terminated, cancelled or you did not renew then you will be required to apply again. It is at our own discretion to waive any application process.
- We reserve the right to waive the application requirement for any applicant, member or prior-member at any time at our own discretion.
- The Lexo Club reserves the right to refuse access to goods and/or services to a member at our own discretion.
- The Lexo Club never guarantees entry to any venue and entry is at the discretion of the venue at all times.
- The Lexo Club reserve the right to refuse and/or accept any application to become a member of The Lexo Club for any reason whatsover at our own discretion.
- By completing an application and/or signing up to become a member with The Lexo Club and linking a Payment Method to your account with us, you authorise us to charge your Payment Method for the Membership fees. We will of already asked you if you wish to pay via Monthly Payments (if available for the selected membership tier) or via one annual payment.
Monthly Payments
- The Lexo Club may offer monthly payments as a method of paying your Membership fees (if applicable).
- By joining a Membership Plan and opting for Monthly Payments, you agree to pay the agreed monthly membership fee for a minimum of six months. You can then cancel at any time after the six months until a new contract has been made.
- If you then opt to upgrade from the your current plan to a higher tier of membership (and are accepted), you will be able to start a new contract and end your 6 month Gold Card Minimum early.
- The Lexo Club reserves the right to offer the ability to end their monthly payments contract minimum at our own discretion.
- We may not yet be offering the ability to pay membership fees on a monthly basis and you understand that expectation to pay monthly is never acceptable for outstanding payments or failure to pay.
- All membership plans/tiers can still be paid annually and you will incur a discounted price (compared to Monthly Payments multiplied by 12 months).
- The Lexo Club reserves the right to change the price of the monthly payments at any time. If changed at more than 10% in a 6 month period, then the member will have the right to cancel their membership and stop paying monthly payments.
- By opting to pay membership fees on a monthly basis (rather than annually), you void your entitlement to a free of charge physical membership card. You will not be sent a physical membership card and must request one from the concierge if you wish to obtain one (you will be charged for this).
Guests
- Members are responsible for ensuring that any guests of theirs taking advantage of Lexo Club benefits in any form are following all terms set by us.
- Someone under the age of 18 years of age may be able to attend events as a guest of the member at the responsibility of the member to ensure that they are both following all terms set out by us.
- You must always inform us if a guest of yours is under the age of 18 years old so we can ensure their access to an event or venue.
- The Lexo Club reserve the right to viewing proof of address, passport or driving license and running a background check on any guest of a Lexo Club members guest at any time.
- The Lexo Club reserve the right to refuse access to a guest of a member at any time at our own discretion.
- By applying for membership, submitting your email to us and/or being a member, you agree to recieve (but not limited to) marketing and news emails from The Lexo Club. We may use third party software & services to deliver these emails on our behalf.
Representing The Lexo Club
- Members and their guests are expected to behave in a manner that does not damage the reputation of themselves and The Lexo Club whenever attending any events, venues or reservations made on their behalf by us. You are also expected to behave accordingly when attending venues associated to us but not booked using The Lexo Club as you are a member at all times.
- You and your guests are expected to arrive at the venue within the allotted timeframe.
- You and your guests must also not engage in any antisocial or illegal behaviour.
Member Responsibilities
Members are responsible for:
- Paying all charges, fees, duties, taxes and assessments that arise out of the Member's use of The Lexo Club's Service or any services that it buys.
- Ensuring that they (and any individuals receiving the benefit of the services) comply with these terms and any other terms or requirements from suppliers.
- In some circumstances, a member may be offered a refund in relation to any issues with services offered by a supplier. The member should be aware that they may waive any other rights or remedies they may have if they accept this refund.
- Members should notify us of any complaint or claim they have in relation to the services or any use of The Lexo Club's Services as soon as possible and ideally within 30 days of the end of their booking. If we are to make a complaint on your behalf for goods and/or services we bought on your behalf, then you are responsible for factoring in time it takes for a member of our team to handle the request and make the complaint.
- Members are responsible for ensuring they have their membership card issued by The Lexo Club on their person at all times when taking advantage of services provided by The Lexo Club.
Personal Information
- The Lexo Club reserve the right to collect & store any personal information you provide to us. We consider you "providing us information" if you submit it to us in a form, application or via any form of communication between us and yourself.
- We store personal information about our members to be able to provide lifestyle services on a long-term basis. We often require information about our members personal life when completing and/or handling concierge requests or tasks.
- The Lexo Club must responsibly make full efforts to secure and protect it's members' data from a data breach or generally.
- All members and customers/clients can contact the concierge at any time to find out what information we hold about you on your account & on our records. We can then delete or remove any information, that you do not want us to hold.
- We reserve the right to terminate your account and membership with us, if you request that we delete essential personal information. This is because we require some personal information to be able to offer you our service and if you request that we no longer store it, then we are left with no choice but to terminate your membership & account. Your membership will not be refundable, if it is terminated due to this reason. Most data we store can be deleted or removed from your account without causing account termination.
- The Lexo Club and its employees, may update your personal information based on what you tell us via communications. So that we can offer you a better service. For example, if we have on our record that you are not a student and you then tell us via a phone call that you are, we may update your account to reflect this.
- The Lexo Club agree never sells your data or personal information. We go into more depth about how we may share your personal data/information with our partners and affiliates, where necessary (for example, to carry out concierge requests/tasks), in other sections of this Terms & Conditions document.
The Lexo Club's Responsibilities
- We are responsible to members for making the applicable arrangement for services being booked by a member through a supplier to our best ability. Once the booking has been completed, we are not responsible for the performance of any contract or experience members have with suppliers.
- We are not responsible for any personal injury or property damage arising out of our caused by any negligent act or omission on the part of any supplier, air carrier, hotel operator, ground transportation contractor, optional tour operator or any person providing any services being offered through The Lexo Clubs Service.
We are also not responsible for:
- Any changes made by a supplier, or other provider such as (but not limited to) air carriers which are beyond our control (this includes (but not limited to), for example in relation to flights, routing changes, aircraft equipment changes, flight cancellations or any changes to flight schedule); or damage, delay or vacations affected by weather or other events beyond our control. Please note we are only responsible for making reasonable efforts to protect your rights, your business is primarily with the supplier for the issued goods and/or services.
- We, or any suppliers, may need to vary or substitute the services for bookings that are substantially similar if necessary due to circumstances beyond its control. We or the supplier will try to notify members if a variation is required.
- We will pass on any special requests from members such as room location, special meals or assistance to the appropriate party, but we cannot guarantee that these will be available or provided. Special offers may be withdrawn at any time before the booking is completed and full payment has been received and price rates are based on availability for all goods and/or services.
- We are not responsible for any injury, death, loss, claim, damage, act of god, accident, delay or any incidental or consequential damages of any kind, whether based in contract, tort (including negligence) or otherwise, which arise out of or are in anyway connected with any purchase or use of services from a supplier, except where such loss results from our act. omission or error. For example, we are not responsible for any damage and/or delay due to any cancellations, shortages, sickness, pilferage, labour disputes, bankruptcy, machinery breakdown, quarantine, government restraints, weather, terrorism, defect in any vehicle, acts of god, war, riots or by any company or person involved in conveying the passenger or in carrying out travel arrangements or causes beyond our control.
- We also cannot be responsible for any additional expense, omissions, delays, re-routing or acts of any governmental authority or any other costs incurred by a member or other individual as a result of use of services.
As stated above, we provide arrangement services to the Members to allow them to enter into contracts with suppliers. Members are responsible for ensuring that services are suitable for them and that the suppliers are able to provide the services, we do not provide any guarantees in relation to the suppliers or good and/or services.
To the extent allowed under any applicable law, we are not responsible for a supplier's breach or any warranty including, for example, any warranties implied by law in relation to a service being satisfactory quality or fit for a particular purpose, nor are we responsible for any other wrongdoing of a supplier including, for example, their failure to comply with these terms or applicable laws (to the extent they apply to them).
We do not guarantee that the site, or The Lexo Club's Services will always be available or uninterrupted. We may suspend or withdraw or restrict the availability of any service or feature of membership that we offer at any time for business and operational reasons.
If we are found liable for any loss or damage relating to a member's use of The Lexo Club's Service's (or in connection with any services purchased through the concierge service), our liability shall in no event exceed the amount paid by the member for the relevant part of the service booked through The Lexo Club.
We and the suppliers may need to make minor adjustments in the member's or other individuals' booking and to cancel any booking prior to its start or departure. If a booking is cancelled by us, we will offer a full refund, which shall be considered a full settlement of any and all liability we or the supplier may have to the member and any other individuals due to benefit from the services. In a case where a booking is cancelled by a supplier then we will start the process of attempting to recieve a refund to be passed on to the member on the members behalf. We offer no guarantee to getting a refund from suppliers on a members behalf and will make reasonable efforts to do so.
Any vouchers, tickets, passes or services provided to any individual from us shall be provided under these Terms and Conditions. This applies to both members and non members who are benefitting or using our services directly.
All rates published are based on exchange rates and tariffs and may change. All taxes, gratuities and porterage charges may be subject to deletions, additions or changes without notice to the member. These changes are not within our control and therefore we cannot always anticipate these changes or notify members that the change has occurred.
We and the suppliers are also not responsible for any changes initiated by the Member of other passenger after departure.
Reasons for collecting information
The Lexo Club regularly collects & stores a large array of personal & general information about our members & customers/clients. We do this because we are lifestyle managers and require this information on a daily basis when managing your lifestyle. The Lexo Club are devoted to providing a seamless, smooth and personal service and to do so we operate in this fashion.

We are often required to place the member's title on their tickets or when purchasing products/services on their behalf. We are required to know this for that purpose. |

We collect our members' address because we (or third party / partners) will often be sending our members tickets, products etc. We also use this to post membership cards. We also use this address when an order is made or to offer location-based concierge & lifestyle management services. The Lexo Club also use this when offering chauffeur services. |

All of our members must be a minimum of 18 years old (global rule) and therefore we must verify an applicants/members age. We also may use this to celebrate their birthday and maintain a personal relationship with our clients. This is a required field. |

The Lexo Club operates its service by communicating with its members' and applicants primarily via email or phone. We require an email address to contact our members or applicants. |

Identification Document |
As previously mentioned, The Lexo Club requires its members to be a minimum of 18 years of age. We must verify this to ensure we can operate our services. We ask for a legal identification document that verifies the applicants/members age. Due to the fact that we offer access to the most exclusive events regularly, we must ensure the security team are satisfied with ensuring our members can attend and having all of our members uploaded ID is a significant security check. We may share your Identification Document with a third party to comply with an events security team, however we will always ask your permission on each occasion. |

To maintain a personal relationship, we ask about the members/applicants personal life. This helps us better understand the member/applicant and their lifestyle. This is not a required field. |

Student Status |
We ask our members/applicants if they are students because we often are able to offer Student Discount on ticket requests and/or offer access to student events. To do so we require knowing whether or not our member/applicant is a student. |

To maintain a personal relationship, we ask about the members/applicants personal social media accounts. This helps us better understand the member/applicant and their lifestyle. We may also use this for security checks. This is not a required field. |
Entertainment favourites |
We ask our members/applicants what they enjoy doing for entertainment. This is collected for the purpose of offering personal and high standard lifestyle & concierge services. |
Interests |
We ask our members/applicants what their interests are. This is collected for the purpose of offering personal and high standard lifestyle & concierge services. |
Does the applicant/member visit any of our partner venues? |
We collect this information to better understand what lifestyle & concierge services we should prioritise or focus on, in regards to each member/applicant. |
Children Status |
We ask our members/applicants whether or not they have children. This is collected for the purpose of offering personal and high standard lifestyle & concierge services. |
How did the applicant/member hear about The Lexo Club? |
This is collected to aid our marketing research and better understand what advertising or marketing campaigns we issue or operate work. |
Has the applicant/member ever been banned from a Partner Venue? |
The Lexo Club reserves the right not to offer lifestyle & concierge services and/or membership of any sort to applicants/members who are banned from any partner venues or companies affiliated to us. We reserve the right to suspend or ban active memberships for this reason. |
The Lexo Club may also ask other questions about their prior use or intended use of The Lexo Club's Services, this is to help the member/applicant's application be processed correctly. We also collect payment information, however we use a third party service to keep this secure. Our third party provider for this service is Chargebee & Stripe and they offer the secure technology we use to keep payment information secure and process secure payments.
- Members & Applicants of The Lexo Club have the right to contact us in regards to what information we hold about you at any time. We can remove any data/information we hold about you at any time, upon request. However we reserve the right to suspend your membership with us if we believe (at our own discretion) we cannot operate in full capacity due to the removal of data/personal information. We may suspend or not offer certain benefits to membership, services or products due to not having the minimum required information to operate.
- Rejected applications are stored on our system as a record for future applications made by the same person. Each applicant who was rejected has the right to request the removal of any prior applications.
- The Lexo Club reserve the right to request personal information to update out-of-date date stored in our system. We aim to do this on an annual basis. It is each members' responsibility to keep personal information we store about them up to date and accurate (to the best of their knowledge).
- Providing knowingly false information to us, will result in a suspension or ban of membership and/or services & products. We will not issue refunds to members who knowingly provide us false information. If you are paying via monthly payments we may ban or suspend access and you will be required to continue making monthly payments to the end of your 6 month term. The Lexo Club may also report any fraudulent activity to the local authority or local police department.
- Someone who was gifted or purchased a service or product from us or our partners (on our behalf) may have their data stored in our system in the exact same way a member of The Lexo Club's data is stored. You will not have an active or valid subscription linked to your account but your data will be stored. You have the same rights and terms & conditions listed above or that are available to members.
Services
- Membership entitles you to all benefits listed on our website. These are constantly being negotiated and new benefits added. We reserve the right to withdraw any benefits of services of membership at any time. In addition, we shall endeavour to provide any lawful, proper and moral service requested by its members.
- Should be we unable to deal with any request, we will inform you as soon as reasonably possible.
- Your service is available during the times set out in your membership and shown on our website. If assigned a personal concierge manager, though all endeavours will be made for this manager to be available for you at these times, there will be occasions when this may not be possible.
- The Lexo Clubs service we provide by phone, messaging, app, email and social media includes: the ability to place a new request with The Lexo Club Concierge, the ability to book services and order goods with suppliers ("Services") and the ability to request to be updated on specific information.
- If you use the phone number provided to you or published on a site to call and speak to one of our representatives, please note that telephone calls may be recorded and monitored for quality and training purposes.
- We reserve the right at any time to modify The Lexo Club's Services that we provide to you and to add or remove content or stop providing the service as a whole for any reason.
- Where a service requires a deposit to be paid you hereby authorise us to debit your Payment Card for the amount of any deposit paid by us on your behalf. This may be forfeited, subject to the terms and conditions of the service, as a result of cancellation. A very small number of exclusive venues and services may require a surcharge to secure a booking or service. Any payment will be advised and confirmed with you prior to booking.
- When ordering a product or service or accessing a benefit, you may be required to provide your payment card details. If you request and authorise The Lexo Club to use your Payment Card in order to pay a supplier for products or services, you acknowledge and agree that The Lexo Club shall have no liability in respect of or be responsible in any way whatsoever in use of your payment card provided that we act in accordance with the instructions issued by you.
- In the event we are requested to make a purchase on your behalf you authorise The Lexo Club to deduct the amount plus any applicable charges. If payment of any sum due under this agreement is not received by any due date specified for that sum, we shall be entitle to charge interest on the outstanding amount at a rate of 8% above the base lending rate of the Bank of England, accruing daily. Occasionally, certain goods and/or services may incur a pre agreed handling fee, you hereby authorise The Lexo Club to debit your Payment Card to cover these. You will always be notified of these fees prior.
- The Lexo Club reserves the right to add a handling, admin and/or processing fee to any transaction made with us.
- When purchasing tickets, in some cases, The Lexo Club may have to pay service charges resulting in above face value prices. These will be agreed with the member before any transaction takes place. All sales are final, no refunds or cancellations are issued after you have purchased your tickets.
- Where action has commenced following your instruction, it is at the discretion of the relevant affiliate as to whether this action may be cancelled.
- Unless otherwise stated in writing by us and with the exception of some travel bookings, when you make a request for goods or services from a supplier through The Lexo Club you will enter into a contract directly with the supplier for the provision of goods or services and you will be bound by the supplier's terms and conditions (including but not limited to their cancellation and/or return terms). In these circumstances, it is very important for you to review any applicable terms and conditions before you complete the transaction.
- Where there are specific terms and conditions between us and you for types of services provided by email, app, messaging, phone or social media these are outlined below.
- We often use the phrase "Elite Status at Partner Super Clubs" or "Elite Status" in regards to venues we work with. When using this phrase we are referring to the service we provide in making best efforts to provide our members with VIP treatment and access to exclusive venues.
- We reserve the right to limit the amount of Concierge requests a Gold Card Member can make at our own discretion due to the tier of membership. The member may be required to upgrade for further access to the concierge.
- Tickets for attractions, museums and points of interests are often provided by an external supplier and you are subject to their terms and conditions. If you have any issues with your experience then your complaint and any disputes will be with that supplier. The Lexo Club will make reasonable efforts to assist you in contacting our external supplier.
"Full Concierge" Access
- The Lexo Club and its partners sometimes state that "Full Concierge" access is included and we define this as access to; 'Elite Status at Partner Super Clubs', 'Priority Preferential Booking & Reservations at Restaurants Globally', 'Access to The Lexo Club's Chauffeurs (May require 3 hours notice)', 'Skip the queue at countless number of attractions, museums and points of interests globally' and 'Shopping feature that includes sourcing items and private shopping access'. The Lexo Club is not required to handle any requests outside of the above listed categories.
- "Full Concierge Access" is provided for a limited amount of time. At the minimum, it is provided for the day(s) that the event/package lasts.
- "Full Concierge Access" is not a feature of all packages and/or products and/or services. It must be listed as a feature of a product/service/package to be included.
- All the terms and conditions listed in this (whole) contract apply to concierge use when provided as "Full Concierge" access.
- Requests for future use (where the Client doesn't have access to those features) is acceptable as long as the initial request is logged when they have access to the features. This request will be handled fully even if "Full Concierge" access has ended.
Chauffeur Service
- The Lexo Club contract an external partner/supplier to provide our members with a chauffeur service. The Lexo Club work closely with drivers and the supplier to manage drivers and also their interaction with our members.
- We only share your name, contact details and your itinerary with drivers to ensure we can offer you a luxury service.
- By using the chauffeur service we provide, you have agreed to the individual terms and conditions of our supplier, which can be read by requesting them from The Lexo Club Concierge at any time. You must read and agree to those terms before using the chauffeur service we provide. It is your own responsibility to read and agree to those terms and by using our chauffeur service, that will confirm you have read and agreed prior to your usage.
- If you have any complaints or issues with a driver or car or chauffeur experience then please make all complaints to The Lexo Club.
- We often use our chauffeurs to carry out tasks on behalf of The Lexo Club Concierge. Please note that this is still subject to the terms and conditions and tasks completed are not the responsibility of The Lexo Club, but the external supplier. By using the concierge, you have provided us with your permission to use external chauffeur suppliers to assist us in tasks and understand they are liable for any issues incurred while completing the task.
- By using The Lexo Club's Chauffeur Service you agree to be charged the following published pricing listed at this page (on this website). You understand pricing is subject to change and can & may be raised or lowered at the discretion of The Lexo Clubs staff. Pricing may be different based off of demand than what is published on our website.
- You agree to all additional fees on top of standard pricing that can be found on our pricing page. This is also subject to change.
- You understand that all chauffeurs are employees of an external company and complaints about them are to be dealt with by our external supplier and not The Lexo Club. The Lexo Club is not liable for any issues or problems that are due to the chauffeur service.
The Lexo Club Members Only Store
- We may refer to The Lexo Club Members Only Store as (but not limited to) "Store", "The Lexo Club Store", "Online Store", The Lexo Club Member Store" etc...
- Some products may be sold to you by an affiliate partner and/or external store, in which you are responsible for reading and agreeing to their own terms and conditions. You also understand that The Lexo Club takes no responsibility for orders made outside of this website and that you will be using their service at your own risk and free will.
- If a Client is not satisfied with an order and believed that grants a refund then they must submit a Refund Request online or by contacting The Lexo Club Concierge within 14 days of the order being placed.
- The Lexo Club reserves the right to refuse all returns/refund requests unless the item is faulty. Please contact The Lexo Club Concierge ([email protected]) to submit a returns request and they will be able to advise and assist you.
- If your goods develop a fault within 28 days of delivery (including goods delivered with a print or manufacturing fault), the goods may be returned for either refund in full or replacement. Replacement only is offered after 28 days and before 12 months. In all queries relating to faulty goods, we require customers to provide photographic evidence so we can investigate the issue. These promises do not apply to faults caused by accident, neglect or misuse.
- Gift Cards, Vouchers, City Guides (digital) and any other digital product/services are not refundable due to the nature of the item.
- Experiences and/or Services sold to you under The Lexo Club Members Only Store are strictly non-refundable due to the nature of the product/service.
- Shipping costs that are included in prices are not included in any refunds provided.
- If you are issued a refund then please note that we will refund you the full payment we received after payment processing fees. These are subject to change by Stripe, our payment processor. Please read into their payment processing fees for merchants to find out more or ask the concierge to see what fees are associated with refunds. We do not take profit from refunds and issue refunds only in that sense. We may automatically issue your refund as credit linked to your membership with us that is automatically deducted upon your next payment with us. If you want a payment via bank transfer then please mention this in your refund request. This is capped at 10%.
- All prices include standard delivery within the UK and we ship worldwide. Additional fees may apply for alternative delivery method and/or shipping outside of the UK.
- Some deliveries must be signed for and you should keep your receipt.
- If goods are showing obvious signs of damage in transit upon receipt, please refuse to accept the delivery.
- All goods are examined in detail by ourselves prior to dispatch to ensure that they leave our warehouse in perfect condition. However, transit damage unfortunately can occur. If your purchase is showing obvious signs of transit damage upon delivery, it is your responsibility to refuse to accept delivery and notify us immediately.
- If damage is only evident upon opening of packaging, then you must inform us within 48 hours of receipt. In either case, we will then arrange the re-delivery of replacement goods as soon as possible.
- If an order that has been shipped does not arrive with you within the recommended shipping time, please contact us at The Lexo Club Concierge ([email protected]) with the order number and we will look into this for you. We do have to allow the carrier reasonable time to deliver your order, however, after this time has passed we will issue a reprint and dispatch replacements if they are deemed to be lost in transit. Please note we have to be made aware of any orders not received within 28 days of the order being shipped.
- If you make a purchase via our store and do not have a valid & active membership with us or have been granted written permission to access the store, then your order will be cancelled and not refunded. It cost The Lexo Club money every time an order is placed by someone who is not a member and therefore cannot issue refunds due to this error. We do our best to only allow store access to members after they have logged in but are aware that there are ways around this and we would also consider this illegal activity and theft.
Dining
- The Lexo Club works with third party restaurant and dining suppliers to offer exclusive and non-exclusive bookings, special benefits and offers to members as part of The Lexo Club's Service.
- You accept that special benefits and offers with suppliers are subject to availability and may change from time to time without notice. It is important to note that not all of the services made available or provided on the site are available in all jurisdictions.
- We reserve the right to deny restaurant reservation requests from you and/or charge cancellation fees on behalf of suppliers if you repeatedly fail to show up for bookings or violate any suppliers terms and conditions including their cancellation terms.
- If you are late, break the (sometimes verbal) terms of the agreement or do not show for a reservation then The Lexo Club may incur deposit charges in which we will pass on to you with an additional 10% to cover all fees we have incurred with this charge.
- We can never guarantee access to a reservation at any restaurant unless we have confirmed your booking. We will always make reasonable and best efforts to provide you with exclusive access to priority reservations at all restaurants globally.
- Please note that your reservation and business is then with the chosen restaurant/bar/business and out of The Lexo Club's control. We always hope for you to have the best & most pleasant experience but do not make any guarantees, nor accept any responsibility for your experience.
- The Lexo Club expects you to report any feedback, positive or negative, about your experience to us and also raise any issues you encountered so we can internally investigate for our own records. We can be contacted at "[email protected]" or "[email protected]", regarding these matters. We do not make any guarantees to resolve issues or create resolutions, nor do we accept responsibility for any bad experiences. Internal investigations allow us to see whether or not we should blacklist certain establishments from The Lexo Clubs Members. We take all complaints and issues seriously but also do not blacklist easily without solid evidence of mis-conduct or illegal activity that is at the responsibility of the business management. The Lexo Club reserves the right to keep investigations and the outcomes of investigations private at our own discretion. We also reserve the right to have our management department decide on all outcomes of investigations at our own discretion with no outside council.
Tickets & Passes
- The term "Pass" or "Passes" may be used in reference for tickets or types of tickets.
- The Lexo Club works both as a primary supplier and with third party ticketing and event suppliers to quote details of face value tickets, hospitality tickets and tickets from secondary market agents to members as part of our service.
- All tickets and passes are subject to availability and prices quotes may change should there be a delay in purchase, exchange rate change or availability change.
- If you decide to order tickets from us directly or a supplier quoted by us, you shall authorise us to arrange payment of the tickets on your behalf. Once you have given us authorisation to purchase tickets with the supplier on your behalf, you will be liable to pay the full price for the tickets. Once the purchase is confirmed, no refunds or exchanges will be available.
- In some cases, we may have to pay service charges resulting in above face value prices. These will be agreed with the member before any transaction takes place.
- You shall enter into a contract for the sale and/or supply of the tickets with the relevant supplier. We shall not be party to this contract.
- You should ensure that you check both the booking confirmation and he tickets you recieve and notify use immediately if any details are incorrect or there are any discrepancies. Where an error has been made by us, we will endeavour to resolve the error with the appropriate level of cost and/or compensation. In all other cases, we will endeavour to assist you with correcting the error without incurring any financial liability.
- We will endeavour to advise you if any tickets have restricted view prior to your purchase. Tickets will be considered restricted view only if specified by the supplier, box office, venue and/or on the physical tickets.
- The Supplier, together with us, will select the method and company used for ticket delivery. Often tickets, will be sent via secure post or courier, which will require a signature upon delivery. When delivery is attempted, if you are unavailable you will need to collect from the local sorting office, or, where appropriate organise a re-delivery directly with the courier company. We will offer support with any deliveries but will not be held liable for errors not caused by us.
- Tickets are usually delivered between 5 to 7 days before the date of the event, with the exception of theatre tickets, which are sent once after the booking is made. The date upon which tickets are released is controlled by the promoters of the event (and not us), who often delay delivery in order to reduce both fraudulent activity and the risk of tickets being misplaced.
- When tickets are purchased through secondary ticket agents, suppliers and/or partners, the supplier will make every effort to deliver them several days, before the event. However, they reserve the right to deliver tickets up to 24 hours in advance and on rare occasions, may arrange for you to meet a representative of the venue.
- It is your responsibility to advise us of any change of address, which may affect your booking, or if you plan to be away in the days leading up to the event.
- If tickets are misplaced and originally purchased through a face value box office, tickets can often be duplicated. It is unlikely that tickets will be re-issued prior to the event date and will therefore need to be collected from the box office. In order to collect tickets in this way, the cardholder and the card that was used to purchase the tickets need to be present. Letters of authorisation are subject to the venue box office's discretion and in some instances, may not be accepted. It is your responsibility to leave The Lexo Club enough time to organise your ticket collection in this scenario if we are responsible as the cardholder for the tickets.
- If tickets, purchased through secondary ticket agents are misplaced, it is extremely difficault to arrange duplicates or box office collection, since they usually need to be collected by the individual who originally purchased the tickets. If this occurs, we will endeavour to arrange for duplicates or collection, but if we are unable to do so then we cannot provide a refund.
- If you find you are unable to attend an event and would like advice on re-selling your ticket, please contact us for further information.
- While we endeavour to update you if we become aware of any changes made to the date or time of your event, we cannot take responsibility to inform you if an event is cancelled or to provide details if it is rearranged by the event promoter. Where tickets are purchased through the secondary market, tickets will usually be valid for the rescheduled date automatically. If you are not able to make the new date, refunds are at the relevant supplier's discretions. We are not responsible for any additional financial outlay, such as for accommodation or transport, that occurs as a result of a cancelled or rescheduled date.
- For tickets purchased direct through the box office, if the event is cancelled, you will recieve a full refund direct from the box office. If the event is postponed then refunds will not be given until a new date has been rescheduled. If you cannot attend the new date, then you are normally entitle to a refund.
- All refunds that we issue on behalf of a supplier for any goods and/or services may be subject to a fee, capped at 10%, to cover any fees we occur in processing that refund. This is normally due to our payment processing fees that we cannot avoid. We may at our own discretion offer you a full refund with zero fees as credit applied to your account with us.
- Please ensure you check your credit/debit card statement that your card has been charged for the amount of your tickets within 3 to 5 days of booking. If this is not the case, then please contact The Lexo Club Concierge immediately.
- In the unusual event that a supplier (box office or secondary market ticket supplier) goes insolvent, bankrupt or does not deliver the tickets, we cannot accept liability for the loss of tickets. The relevant terms and conditions between you and the Supplier will apply. We shall offer assistance and act on your behalf to endeavour to remedy the situation. As a minimum this will include: advising the member of the chargeback process, if they have paid by debit or credit card, whereby Visa / Mastercard / Amex go to the vendor to try to re-coup the money. Note that there is a time limit within this chargeback process is applicable. And/or: if the member chooses to purchase new tickets, sourcing alternative tickets to match the original order as closely as possible in terms of location, price and date. We will also try and process a chargeback from our business bank account if we purchased the tickets on your behalf in this situation.
- Tickets may appear above the original the original selling price, however please note you are often buying a ticket package not the ticket as other included benefits such as 'Full Concierge Access' is included and reflected in the price. Please ask the concierge about this in regards to each package.
Reseller
- Tickets, Products and/or Services that are purchased from us with the use of reselling without formal written permission, will be made instantly void.
- Purchasing tickets, products and/or services from The Lexo Club as a general member with the intention to resell them is strictly forbidden and may result in a suspension or ban of all services and use of membership. Ticket, Product and/or Service suppliers should never use our general membership plans, without permission of The Lexo Club Management Department, to source tickets, products and/or services for the intended use of resale.
- Business-to-Business (or "B2B") Partners may resell tickets, products and/or services of ours with formal written permission directly from a member of the Management Department at The Lexo Club. These partners are allowed to use The Lexo Club as a provider of tickets, products or services for commercial use under a bespoke license received before hand by The Lexo Club.
- Customers of Business-to-Business (or "B2B") partners (who are authorised to resell tickets, products and/or services) will not be required to be a member of ours to using the tickets, products and/or services that we provided our partner.
Ticket Purchases, Cancellations & Refunds
- The Lexo Club aims to ensure that package benefits remain available to the Client at all times. If any of the benefits become unavailable, The Lexo Club will make good faith efforts to see that prior commitments are honoured to the fullest extent possible, but shall not be responsible for any actions of third parties, third party suppliers or events beyond The Lexo Club’s physical control. If entrance with procured invitation to the event is denied to the Client at no fault of the Client, a full refund will be issued to the Client via credit card or bank/wire transfer within 10 business days.
- All sales are final. In the event a purchase results in cancellation by fault of the Client in which The Lexo Club has acted as a credit agent or vendor on the Clients’ behalf and purchased invitations in advance of payment from the Client for said event, the Client hereby agrees to reimburse The Lexo Club for the full amount due for said invitations.
- Refunds will only be issued in the event that The Lexo Club fails to procure invitations for the Client. Some events are two fold in that an afterparty happens after an award or show or event. If the client attends an afterparty, the cost of this, determined by The Lexo Club, will be deducted from any refund offered. In the event the venue does not perform the engagement or if invitations to an event are not issued or honoured at no fault of the Client, The Lexo Club shall issue a full refund to the Client within 10 business days.
- On occasion if agreed by The Lexo Club, should a client cancel a purchased ticket, we will make all efforts to resell their tickets on their behalf. Should The Lexo Club be able to resell the tickets, the client will be refunded the lesser of: a) 80% of the resale price of the ticket b) 80% of the original purchase price from the client.
- The Lexo Club’s procurement of invitations is subject to the following provisions: a) The Lexo Club are not the issuer, original seller or a reseller of invitations. Invitations purchased are not commercial offerings available through retail channels and are sold at prices obtained directly from suppliers, which may include service charges reflecting costs and efforts in obtaining the invitations. b) Invitation prices are not set by The Lexo Club and are subject to market conditions and demand.
- The Lexo Club will not be held liable for a venue’ s failure or postponements and cannot be held responsible for venue’s inability to hold an event by accident, Acts of God, riots, strikes, labour difficulties, epidemics, any act of any public authority or any other cause, similar or dissimilar, beyond venue’ s or The Lexo Club’s control. In the event of the event being cancelled by the venue, The Lexo Club will make best efforts to issue a refund within 10 business days.
- The Lexo Club reserves the right to withdraw any of these services and/or to refuse to supply the services requested and in such case The Lexo Club will issue an immediate and refund via wire transfer to Client within 10 business days of contract breach.
- If The Lexo Club is unable to fulfil any request, we will inform the Client as soon as reasonably practicable and in such case The Lexo Club will issue an immediate and full refund via wire transfer to the Client within 10 business days of contract breach.
- When issuing a "full refund" and/or a refund you may be subject to payment processing fees, these are always capped at 10% and normally do not exceed 3% + £0.20 per transaction. These fees are out of our control and are the cost we have when issuing refunds or collecting payments.
- The Lexo Club are often required to perform security checks on its Client(s) or pass over information or Identification Documents to the event hosts or security partners, for the purpose of security checks. By being a member, customer/client or guest of ours, you provide us with permission to share this information/data with the required third-party for the purpose of security checks. You also understand that if you do not pass a security check, then it is out of The Lexo Club's control and a refund may not be possible. In this situation, The Lexo Club must make reasonable efforts at their own discretion to resolve this issue and the Client will be entitle to Full Concierge access as a perk or upgraded benefits (the Client is responsible for requesting this).
Ticket Liability
- The Lexo Club shall use its reasonable endeavours to provide the services with reasonable care and skill and, as far as reasonably possible, in accordance with the Client’ s request and instructions from time to time. Where The Lexo Club supplies the Client with any goods or services supplied by a third party, then The Lexo Club is acting as the Client’ s agent in sourcing the goods or services. The Lexo Club will use reasonable care in selecting the supplier and ensuring the order is placed in accordance with the Client’ s wishes. For the avoidance of doubt, The Lexo Club does not and will not provide any representations or recommendations in relation to any of the information and suggestions comprised within the services.
- The Lexo Club will only be liable to deliver the package described in the invoice sent (or the online payment gateway). Any additional event and package information required will be conversed to the client via emails or telephone conversations, however, it should be noted that though all endeavours will be made to ensure this information is accurate, The Lexo Club will not be held responsible for inaccuracies in this information unless they result in the result in the client being unable to attend the event. Events do change each year and we rely on our previous experience and third party suppliers to provide this information.
- The Client’ s contract for the purchase of products or services is made with the relevant supplier/partner/vendor only. The Lexo Club acts as an agent for the supplier/partner/vendor and, unless expressly provided otherwise, all the Client’ s rights and remedies are against the supplier/vendor/partner. The Lexo Club, as the agent of the Client, shall make all reasonable efforts to ensure that the Client receives the products/services as marketed/offered to them.
- The Lexo Club will not be responsible for products and services offered by The Lexo Club as agents for the suppliers/vendors/partners or for any aspect of the relationship between the Client and any particular supplier/vendor/partner. The Lexo Club will however do everything it reasonably can to assist the Client in any dealings it has with the supplier/vendor/partner.
- Tickets are not always physical tickets, and may take many forms including, and limited by, names on guestlist, virtual tickets and passes, e-tickets, invitations, being escorted into a venue by a representative.
- The Client agrees that any contract entered into by him/her with any of the suppliers/vendors/partners is an independent contract. The Lexo Club hereby disclaims any and all liability for any act or omission of any supplier/vendor/partner or any loss incurred by the Client as a result of any act or omission of a supplier/vendor/partner whether or not arranged through The Lexo Club.
- Save in respect of death and personal injury caused by the negligence of The Lexo Club or as expressly provided for in these Terms and Conditions, The Lexo Club shall not be liable for any loss, cost, expense or damage of any nature whatever, whether direct or indirect, resulting from the provision of the services or the Client’ s reliance upon the information and suggestions provided by The Lexo Club hereunder and the resulting supply of goods and services to the Client by any third party.
- The Lexo Club shall have no liability to the Client for any loss, damage, costs, expenses or other claims for compensation arising from requests or instructions supplied by the Client which are incomplete, incorrect or inaccurate or arising from their late arrival or non-arrival, or any other fault of the Client.
- Save in respect of death and personal injury and subject to the provisions of these Terms and Conditions, The Lexo Club's maximum liability to the Client for breach of any of its obligations hereunder shall be limited to the value of the services and the charge for the services to be provided.
- This section applies only to the extent permitted by law.
- When purchasing tickets you are doing so in good faith and not in an attempt to entrap The Lexo Club. You are eligible for any costs (including legal) through dishonest purchasing of tickets.
- All arrangements offered are subject to availability at the time of booking.
- The making of a booking with us, however confirmed, shall be deemed as acceptance by the client of the above terms and conditions.
- Please also note that The Lexo Club reserves the right to charge interest at the rate of 2.5% per month over base rate compounded monthly on all overdue accounts.
Events & Benefits
- The Lexo Club works with suppliers, hosts and promoters to share the details of events and/or benefits to our members as part of The Lexo Club's service.
- Benefits are subject to availability and the terms and conditions of the supplier, host and/or promoter.
- Benefits may be withdrawn at any time and without prior notice.
- We may share some of your details with suppliers, hosts & promoters, such as name, contact details etc...
Fraud
- The Lexo Club has a zero tolerance on fraudulent activity and will result in an instant ban or suspension.
- When fraudulent activity occurs, the right to a refund or good and/or services is then waived.
- You agree to not complete a chargeback without first trying to resolve the issue with us first. You understand and agree that chargebacks are fraudulent unless The Lexo Club breaks their terms and conditions or does not attempt to resolve your request.
Travel
- We may engage certain local travel agencies to act solely in the capacity of agent for suppliers of air, hotel, car and other travel-related products and services ("Travel Suppliers") to provide members with the ability to purchase airline tickets, hotel accommodation, car rentals and other travel-related products and services ("Travel Services") in accordance with the Travel policy set out to these Terms, which includes our cancellation policy.
Elite Status & Upgrades at Partner Hotels & Cruises
- The Lexo Club is often able to issue our Platinum & Black Card Members upgrades at partner hotels, for example: Room upgrade, Daily Breakfast (for two per room), Early check-in, Late Checkout and often credit to spend within the hotel/cruise. Those are upgrades for a hotel we are partnered with as an example.
- The Lexo Club reserves the right to issue these upgrades to our Gold Card Members at our own discretion.
- Upgrades as a whole or specific upgrades are never guaranteed when staying at any hotel.
- Available by participating partners only. Please check with the concierge what hotels are eligible for upgrades.
- Room upgrades are always subject to availability.
- Early check-in is always subject to availability.
- Late checkout is always subject to availability.
- When booking an eligible partner Cruise via The Lexo Club you will recieve the following upgrades (where possible, available & eligible): dedicated onboard hosts, private welcome reception, exclusive shore excursions (from VIP tours to outings with a private car and driver) and shipboard credit and speciality dining options.
- The Lexo Club may provide you upgrades and benefits that we offer via the 'Hotel & Cruise Elite Status' benefit via a third party and therefore cannot be always responsible for you receiving upgrades. Elite Status benefits & perks are never guaranteed.
Cashback
- This is an experimental benefit of membership and is not fully launched, where used or offered to a member or guest, these terms and conditions apply.
- The Lexo Club may issue cashback where eligible on hotel, villas and housing bookings.
- Any bookings, where you received an upgrade or any extras due to your membership with The Lexo Club, are not eligible for cashback at this current time.
- Cashback is issued as credit applied to your account with us. It cannot be redeemed under any circumstances, unless we decide to at our own discretion.
- Credit on your account is automatically spent the next time we make an automatic collection charge on your payment method. These are payments we make without asking for your card details and are charged to the payment method linked to your account. For all other payments please contact The Lexo Club Concierge. You can have your account credit/cashback exchanged to store credit to be used in The Lexo Club Store by requesting so from The Lexo Club Concierge.
- Cashback may take up to 6 months to reach your account. This is due to the feature not being launched yet and in an experimental stage.
- The process to issuing cashback can only begin one month after a successful booking was made. This is due to our partners process on verification.
- If there is an issue with the property after such as (but not limited to): outstanding payments, damage or breach of contract (e.g terms and conditions), then we reserve the right not to issue cashback and even suspend or ban your membership with us.
Influencer Partner Program
- May be defined as (but not limited to) the "Influencer Program", "Influencer Affiliate", an "Affiliate" or a "Lexo Club Influencer".
- If enrolled in this program then you will earn £50 per Gold Card Member you refer & £100 per Platinum Card Member you refer as a commission.
- To earn the commission the applicant will have to be successful in being accepted as a member of The Lexo Club by passing the application process and pay their annual membership fee. We will then contact you and make a payment to you via bank transfer.
- You are responsible for all legal duties, taxes and declarations for earnings made via membership fee commissions. The Lexo Club will not advise or take responsibility for this whatsoever. You are also responsible for complying with all terms and conditions of social media and/or internet platforms, in which you may use to broadcast your promotions.
- You must represent The Lexo Club's brand as it is and not make false statements about us or our work at all. You should always make our brand look respectable and excessively exclusive.
- We may at any point decide to change commission rate payments for any reason. This means you may see one day that the rate has moved to a new rate.
- We may remove, suspend or ban you from the influencer partner program at any time with or without reasoning, in which we will contact you once using one of the contact methods provided to us by you. It is your responsibility to keep us updated on any contact detail changes. Once we inform you that you have been removed, suspended or banned from the influencer partner program, then we will no longer pay commission on any referred applicants.
- People you refer will move up the priority list on our applications database. You must inform your applicants to enter your details in the 'referred by' part of the application.
- You agree to all of our terms and conditions listed on this page/document at all times.
Fair Usage Policy
- You must make sure that any use of The Lexo Club's Service complies with these terms.
- If you breach this Policy, we may (a) give you a notice to stop or moderate the unacceptable use(s), or (b) terminate or suspend your membership with or without notice as we consider appropriate under these terms.
- There is no specified limit on the usage of our Concierge Service. However, if we feel that your activities are so excessive that other members are detrimentally affected, we may give you a written notice (by email or otherwise) or limit the number of requests you can submit in a given time period. In extreme circumstances, if the levels of activity do not promptly decrease after the warning, we may terminate or suspend your account after prior consultation.
- You are responsible for all use of the concierge service through your account and for any breach of these terms whether an unacceptable use occurs or is attempted, whether you knew or should have known about it, whether or not you carried out or attempted the unacceptable uses alone, contributed to or acted with others or allowed an unacceptable use to occur by omission.
Complaints
- Please contact us immediately, should you be dissatisfied with any aspect of The Lexo Club's Service that you recieve, and we will use reasonable endeavours to look into the issue within two working days of receipt of your notification and to respond to you as soon as reasonable possible.
- Neither The Lexo Club or any Client represented by us will not be responsible for the failure of any Supplier to provide any Services or negligence of the Supplier providing them. However, we will endeavour to assist you in the resolution of any such issue.
Material
- The material on our Site is subject to our copyright protection, unless otherwise indicated.
- Our copyright-protected material may be reproduced free of charge in any format or media without specific permission, provided that the material is not for public use and not for profit, material or financial gain. This is subject to the material being reproduced accurately and not being used in a derogatory manner or misleading way. You must always credit the information at the top or bottom of the content with "Some of the information in this [ARTICLE/ETC] was kindly provided to us by The Lexo Club Concierge".
- Where the material is being published or issued to others, the source and copyright status must be acknowledged. Any permission we provide to reproduce our copyright-protected material does not extend to any material on our Site which is identified as being the copyright of a third party.
- Authorisation to reproduce such material must be obtained from the copyright holders concerned. If there is a restriction on reproduction, any other proposed use of the material would be subject to our approval.
Intellectual Property
- The Content (as defined below) is protected by applicable intellectual property laws and all Content is owned or used by the Lexo Club under a license or with permission.
- All text, formatting (including without limitation the selection, coordination and arrangement of materials received from The Lexo Club, and the images, graphics, animations, tools, widgets, applications, commercials, videos, music, sounds, articles, copy, creative materials, photos, trademarks, service marks, trade names and logos and other materials and information received by The Lexo Club are subject to the intellectual property rights of The Lexo Club, its subsidiaries and affiliates, and their respective licensors and licensees (collectively "Content"). The Content may not be copied, reverse engineered, decompiled, disassembled, modified, reposted to other websites, framed, deep linked to, changed, or otherwise distributed, redistributed, licensed, sub-licensed or transferred in any form by you. No Content shall be construed as granting, by implication, estoppel or otherwise, any license or right to make commercial use of any Content without The Lexo Club's prior written permission.
General
- Please allow up to 6 months to activate your membership after your application being accepted. You may request that your membership is activated either closer to when your membership card is expected to arrive or straight away (without the card at the start)
- You are responsible for covering any fees & costs if the membership card is lost, misplaced, damaged or stolen.
- You will be asked to add a payment method to your account with us. We will link this to your membership with us and you authorise us to charge that card for costs & charges incurred from requests (for example (but not limited to) tickets, services, etc...). We will always act in accordance to your instruction and ask your permission before applying a charge to your payment method.
- You may update your payment method at any time by contacting the concierge who can do it for you manually or can issue you a 'Update Payment Method Email', which provides you with a one time link to update the associated payment method.

- If you have any queries or comments about these Terms or our or any Supplier's use of your personal data then please get in touch with the concierge via the phone number, email address or website provided for concierge services.
Changes to this Policy
- We reserve the right to update this policy when required without notice unless required to do so by law.
Notices
- A notice or other communication under or in connection with these Terms shall be in writing and shall be delivered personally or sent by first class post, fax, or email to the party due to recieve the notice or communication at its registered address or fax or email address specified in writing to the other.
Indemnification
- You agree to indemnify, defend and hold The Lexo Club, its business partners, staff and affiliates, harmless from any liability, loss, claim and expense, including: reasonable professional legal advisors' fees and expenses, related to your violation of these Terms.
Confidentiality
- The terms and conditions of this agreement are absolutely confidential between the parties and shall not be disclosed to any other party, except when necessary to effectuate its terms. Any disclosure in violation of this section shall be deemed a material breach of this Agreement.
- It is understood and agreed that the parties to this Agreement will provide each other with information that may be considered confidential. To ensure the protection of such information and in consideration of the agreement to exchange said information, the parties, agree as follows, with fully financial penally of funds paid of any breach of the following: (a) The confidential information to be disclosed under this Agreement (Confidential Information) is defined as: documentation issued from The Lexo Club to the Client and/or beneficiaries such as invoices, sales orders, contracts, and terms and conditions, including this document, regardless of whether such information is designated as Confidential Information at the time of its disclosure. (b) The parties shall use the Confidential Information only for performing service under this Agreement. (c) The parties shall limit disclosure of Confidential Information, whether verbal or written, within its own organisation to its directors, officers, partners, members and/or employees having a need to know and shall not disclose Confidential Information to any third party, whether an individual, corporation, or other entity, without prior written consent of the Disclosing Party. The parties shall satisfy their obligations under this paragraph if they take affirmative measures to ensure compliance with these confidentiality obligations by their employees, agents, consultants and others who are permitted access to or use the Confidential Information.
- The existence, nature, terms and conditions of this Agreement are strictly confidential and shall not be disclosed by the Client in any manner or form, directly or indirectly to any person or entity under any circumstances. Further, the client shall not discuss, comment upon, disparage, or disclose any information, in any manner or form, directly or indirectly, online or otherwise, to any person or entity about: (a) The Lexo Club; including its officers, directors, shareholders, agents, employees or other representatives. (b) Any aspect of The Lexo Club's business or operations, and/or (c) Any aspect of The Client's dealings with The Lexo Club.
- The Client shall not assist or cooperate with, any other person or entity in committing any act, which if committed by the Client, would constitute a violation of this section. The Lexo Club shall deem any violation of this section a material breach of this Agreement, punishable by way of immediate undisputed £20,000 fine.
- The parties and their lawyers shall keep the specific terms, conditions and covenants of this Agreement confidential except: (a) Where mutually agreed upon in writing. (b) Where necessary to share such information with the parties' accountants or attorneys or. (c) Where a court of competent jurisdiction orders disclosure.
- The parties and their attorneys shall not communicate with anyone associated with any media or publication entities concerning the terms of this Agreement or allow any information to be released into any publicly available medium in which the press can obtain information. This confidentiality provision is a material term of this Agreement and its violation shall constitute a material and very serious breach of this Agreement.
Governing Law and Jurisdiction
- We grant you access to our Site and our Services conditional upon your acceptance that the laws of England and Wales (United Kingdom) apply between us in relation to these Terms.
- These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by and in accordance with the law of England and Wales (United Kingdom).
- Each party irrevocably agrees that the courts of England and Wales, shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out or in connection with these Terms or its subject matter or formation.
